Terms of Service

1. Acceptance of Terms

By creating an account or using PocketPals, you agree to these Terms of Service and our Privacy Policy. If you are a parent or guardian creating an account on behalf of a child, you represent that you are at least 18 years old and have the legal authority to agree to these terms on behalf of the child.

If you do not agree to these terms, do not use PocketPals.

2. Service Description

PocketPals is a voice-first AI companion application for children ages 3–12. The service features "Buddy," an AI-powered animated wolf character that engages children in safe, educational conversations. PocketPals is operated by NuStack Digital Ventures LLC.

The service includes a parent dashboard for reviewing conversations, setting time limits, and managing content filters. Both a free tier and a paid subscription tier are available.

3. Account Registration

• A parent or guardian (18+) must create the account on behalf of the child
• Children may not create their own accounts
• You must provide accurate information during registration
• You are responsible for maintaining the security of your account credentials and PIN
• You must notify us immediately of any unauthorized account access

4. Subscription and Billing

Premium subscriptions are billed monthly. You may cancel at any time from Account Settings; your subscription will remain active until the end of the current billing period. No refunds are issued for partial months.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect active annual subscriptions during their term.

5. Acceptable Use

You agree not to:

• Use PocketPals with or for children under 3 years of age
• Attempt to extract, copy, or reverse-engineer the PocketPals AI or any proprietary content
• Use automated tools to scrape or access the service at scale
• Attempt to circumvent COPPA safeguards or parental consent requirements
• Share account credentials with individuals outside your household
• Use the service for any purpose that violates applicable law

6. COPPA and Children's Privacy

PocketPals is designed for children under 13 and complies fully with the Children's Online Privacy Protection Act (COPPA). As a parent or guardian, you provide and may withdraw consent for your child's use of the service at any time.

7. Intellectual Property

PocketPals, Buddy, and all associated content, branding, and technology are owned by NuStack Digital Ventures LLC. You may not copy, modify, distribute, or create derivative works from any part of the service without written permission.

Conversation transcripts stored in your account belong to you. You may request a copy or deletion at any time.

8. Disclaimer of Warranties

PocketPals is provided "as is." We do not warrant that the service will be uninterrupted, error-free, or that any specific educational outcome will result from use. AI responses are generated and may occasionally be imperfect — the parent dashboard exists precisely so you can review them.

9. Limitation of Liability

To the maximum extent permitted by law, NuStack Digital Ventures LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Termination

You may close your account at any time from Account Settings or by emailing support@pocketpals.app. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

11. Governing Law

These terms are governed by the laws of the State of Wisconsin, USA. Any dispute arising from these terms shall be resolved in the courts of Wisconsin, and you consent to the personal jurisdiction of such courts.
